Obtain legal guidance for the states in which employees and customers are located, disclose recording clearly and provide a workable path when recording is not appropriate.
Employees should know what is captured, why it is used, who can see it, how long it is retained and how to challenge an inaccurate transcript or score. Limit production data in practice scenarios. Ask every vendor where prompts, recordings and embeddings travel; which subprocessors receive them; whether they train any model; and how deletion propagates through backups and derived data.
Automated scores can reflect transcription failures, dialect differences and a rubric that rewards style rather than substance. Compare error patterns across groups, offer accessible alternatives and require human review before a score affects customer access, certification, compensation, promotion or termination.
